Terms and Conditions
1. Introduction
2nd SIM Limited (Company No. 15847259), registered at 86–90 Paul Street, London EC2A 4NE (“we”, “us” or “our”), provides a VoIP service via the 2nd SIM mobile app (“Service”). By downloading, installing or using the 2nd SIM app, you (“you” or “User”) agree to these Terms. If you do not agree, please do not use the Service.
2. Eligibility
- Age: You must be at least 13 years old to use 2nd SIM.
- Account: You agree to provide accurate, current and complete information when registering. You are responsible for safeguarding your credentials and for all activity under your account.
3. Service Description
- VoIP Calls & SMS: Make international calls and send SMS over Internet (Wi-Fi or mobile data).
- Virtual Numbers: Purchase and use numbers from the UK, US and Canada (more regions coming soon).
- Availability: The Service works worldwide except in France and China.
No emergency calls: 2nd SIM cannot be used for emergency services (e.g. 999, 112, 911). Always use a traditional phone for emergencies.
4. Acceptable Use
You must not:
- Violate any law or regulation (e.g. send spam, harass, defame).
- Use automated systems to overload or tamper with our Service.
- Resell or transfer your virtual number without our consent.
- Use the Service for fraud or illegal purposes.
We may monitor usage to enforce these rules. Violations may lead to suspension or termination.
5. Fees & Payments
- Purchases: You can buy call/SMS credit or virtual-number subscriptions in the app. All fees (and any taxes) will be displayed before purchase.
- Payment Processor: We use Stripe to process all payments. You consent to sharing necessary payment details with Stripe under their Privacy Policy.
- Refunds: Fees are generally non-refundable, except as required by law (e.g. UK “cooling-off” rights).
6. Virtual Number Porting & Cancellation
- You may port in an existing number (subject to regulations) or port out a 2nd SIM number.
- On cancellation or non-renewal, your number returns to the pool after a holding period; missed calls/SMS thereafter are not our liability.
7. User Data & Account Deletion
- You may request deletion of your personal data or your entire account at any time via your settings or by contacting support.
- Upon deletion, we will erase or anonymise data in line with Section 10 below, except where retention is legally required.
8. Intellectual Property
All app content—code, graphics, trademarks—belongs to 2nd SIM Limited or our licensors. You receive a limited licence to use the Service, but you may not copy, modify, reverse-engineer, distribute or sell any part of it.
9. Disclaimers & Liability
- The Service is provided “as is” without warranties. We do not guarantee uninterrupted or error-free operation.
- To the fullest extent permitted by law, our liability is capped at the greater of £100 or the fees you’ve paid in the preceding 12 months. We’re not liable for indirect or consequential losses.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any dispute will be resolved exclusively in the courts of England and Wales, except where consumer rights allow you to litigate elsewhere.
11. Changes to Terms
We may update these Terms. Material changes will be notified in-app or by email. Continued use after updates signifies your acceptance.
